In consideration of being allowed to enter the facilities of, use the facilities of, and/or participate in any program at or put on by ARCHIMEDES MACHINING INC. (“AMI”), or any of their trade names, the undersigned, on his or her behalf and on behalf of the participant(s) identified below, acknowledges, appreciates, and agrees to the following terms and conditions:

I represent that I am the participant, parent, or legal guardian of the participant(s) named below. I agree that the participant(s) named below, and I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions while (1) on the AMI property, (2) utilizing AMI facilities, and/or (3) participating in any program at or put on by AMI (said three items hereinafter referred to as “Activities”). In addition, if I observe any hazard during our participation, I will bring it to the attention of the nearest AMI employee or official immediately.

I am aware of the inherent risks associated with the Activities, including, but not limited to, PROPERTY DAMAGE, SERIOUS BODILY INJURY, SERIOUS PHYSICAL HARM, AND DEATH.

I acknowledge and assume all risks associated with any and all of the Activities, and I promise, agree, and warrant to release, hold harmless, protect, indemnify, and forever discharge AMI and VANTAGE VALLEY PROPERTIES, LLC (“VVP”) and their affiliates, owners, administrators, members, directors, employees, volunteers and agents from any and all causes of action, claims, and demands of any nature for any and all loss, damage, or injuries sustained by Participant(s), Participant(s)’s family members, including children, any other of Participant(s)’s guests and invitees, including children, or Participant’s and Participant’s family members’ personal property at any time during the Activities. I further promise and agree never to institute any claim, suit, or action at law against AMI. VVP, or their affiliates, owners, administrators, members, directors, employees, volunteers, and agents which may arise as a result of the Activities.

I shall indemnify and hold harmless AMI, VVP, and their affiliates, owners, administrators, members, directors, employees, volunteers, and agents from any and all claims for bodily injury, death, or property damage or other losses, claims, causes of action, attorney fees, or other costs which may result or arise, in any manner, from any of the Activities. In the event a minor, whether it be Participant(s)’s children or other individuals with Participant(s), is injured and/or killed and/or suffers the loss of property while engaging in the Activities, Participant(s) specifically agrees to indemnify and hold harmless AMI, VVP, and their affiliates, owners, administrators, members, directors, employees, volunteers, and agents from any and all claims for bodily injury, death, or property damages or other losses, claims, causes of action, or other costs resulting from or arising in any manner or way from said minor’s participation in or attendance at any of the Activities or said minor’s use of AMI’s equipment. Participant’s obligation to indemnify includes but is not limited to, paying for counsel of AMI’s and/or VVP’s choosing to defend against any claim arising out of Participant’s participation in the Activities.

In the event it is necessary to refer this Agreement to an attorney, the prevailing party in such action shall be entitled to its costs and reasonable attorney fees. The venue of any action involving this Agreement shall be in Kittitas County, Washington.
